The Supreme Court has directed the Bihar Government to fill up 34,540 vacancies of college teachers from amongst the trained teachers in order of their seniority...

The Supreme Court has directed the Bihar Government to fill up 34,540 vacancies of college teachers from amongst the trained teachers in order of their seniority after providing for appointment of reserve category candidates as a onetime measure.

A bench comprising Justices Altamas Kabir and H L Dattu also noted, ‘We would like it to be appreciated by the state of Bihar that these directions should be complied within August 31, 2010 without making any further delay.’ The apex court adjourned the hearing of contempt petitions filed against Mr Anjani Kumar Singh, the Principal Secretary Human Resources Development Department, Government of Bihar, till September 8.

Justice Kabir while writing the 13-page judgment for the bench also noted, ‘ It was never our intention that the conditions of the advertisement itself, which has been struck down by the High Court, were to be followed by the Bihar government.

‘It was very clear that all 34,540 posts were to be filled up with trained teachers who were waiting for appointment in order of seniority.

‘We must add that we are not for a moment suggesting that candidates from the reserved categories should not be accommodated as per the reservation policies.

‘What we intended was that after the number of candidates from the reserved category has been accommodated, the rest of the posts were to be filled up from amongst the candidates from the General category.’ The state of Bihar will file compliance report till September 8.
